Point 2 of Annex XIII is the part that makes a battery repairable, and it is 5 data points, all 5 of them due from 18 February 2027: the detailed composition of cathode, anode and electrolyte, part numbers for components, where to source replacement spares, the safety measures, and the dismantling information, which the annex itself breaks into six items down to the tools required and the warnings where a part can be damaged. It does not open on a scan. Article 77(2) ties access to a purpose rather than to a job title, and the purposes it lists are dismantling, safety during dismantling, and detailed composition.

Where the article and the annex do not say the same thing
Visible only when Article 77(2) and the Annex XIII headings are read side by side. It is not settled by the implementing act under Article 77(9), which was due on 18 August 2026 and has not been adopted.
Point 2 has two different audiences depending on where you read it
Article 77(2)(b) grants notified bodies, market surveillance authorities and the Commission access to “points 2 and 3 of Annex XIII”. The heading of point 2 in the annex names only persons with a legitimate interest and the Commission. Read strictly, the annex heading does not admit the authorities the article just admitted.
The article is the operative provision, so an implementer who follows it is on firm ground. It is worth knowing before someone points at the annex heading in an audit.
